India's Supreme Court Strikes Down Electoral Bonds Scheme, Citing Transparency Concerns

New Delhi, India – In a significant ruling, the Supreme Court of India has declared the electoral bonds scheme unconstitutional, asserting that it infringes upon citizens' fundamental right to information. The five-judge Constitution Bench, led by Chief Justice D.Y. Chandrachud, delivered a unanimous verdict, emphasizing the importance of transparency in political funding for a healthy democracy.

The electoral bonds scheme, introduced by the government in 2018, allowed individuals and corporations to donate money to political parties anonymously through bonds purchased from the State Bank of India. Critics argued that the scheme promoted opacity, facilitated quid pro quo arrangements, and allowed for unlimited corporate donations, thereby undermining electoral integrity.

The Supreme Court's judgment highlighted that the anonymity provided by the scheme violated Article 19(1)(a) of the Constitution, which guarantees freedom of speech and expression, including the right to know. The Court stated that the public has a right to be informed about the sources of political funding, as this information is crucial for making informed electoral choices and holding elected representatives accountable.

As a direct consequence of this ruling, the Court has mandated the disclosure of all donors and recipient political parties. The State Bank of India has been directed to immediately cease issuing electoral bonds and to provide comprehensive details of all bonds purchased since the scheme's inception to the Election Commission of India. The Election Commission, in turn, is required to publish this information on its official website within a specified timeframe.
